§ 116-40.5. Campus law enforcement agencies.

§ 116‑40.5.  Campus lawenforcement agencies.

(a)        The Board ofTrustees of any constituent institution of The University of North Carolina, orof any teaching hospital affiliated with but not part of any constituentinstitution of The University of North Carolina, or the Board of Directors ofthe North Carolina Arboretum, may establish a campus law enforcement agency andemploy campus police officers. Such officers shall meet the requirements ofChapter 17C of the General Statutes, shall take the oath of office prescribedby Article VI, Section 7 of the Constitution, and shall have all the powers oflaw enforcement officers generally. The territorial jurisdiction of a campuspolice officer shall include all property owned or leased to the institutionemploying the campus police officer and that portion of any public road orhighway passing through such property or immediately adjoining it, whereverlocated.

(b)        The Board ofTrustees of any constituent institution of The University of North Carolina, orof any teaching hospital affiliated with but not part of any constituentinstitution of The University of North Carolina, or the Board of Directors ofthe North Carolina Arboretum, having established a campus law enforcementagency pursuant to subsection (a) of this section, may enter into jointagreements with the governing board of any municipality to extend the lawenforcement authority of campus police officers into any or all of themunicipality's jurisdiction and to determine the circumstances in which thisextension of authority may be granted.

(c)        The Board ofTrustees of any constituent institution of The University of North Carolina, orof any teaching hospital affiliated with but not part of any constituentinstitution of The University of North Carolina, or the Board of Directors ofthe North Carolina Arboretum, having established a campus law enforcementagency pursuant to subsection (a) of this section, may enter into jointagreements with the governing board of any county, and with the consent of thesheriff, to extend the law enforcement authority of campus police officers intoany or all of the county's jurisdiction and to determine the circumstances inwhich this extension of authority may be granted.

(d)        The Board ofTrustees of any constituent institution of The University of North Carolina, orthe Board of Directors of the North Carolina Arboretum, having established acampus law enforcement agency pursuant to subsection (a) of this section, mayenter into joint agreements with the governing board of any other constituentinstitution of The University of North Carolina to extend the law enforcementauthority of its campus police officers into any or all of the otherinstitution's jurisdiction and to determine the circumstances in which thisextension of authority may be granted.
