§ 120-10.7. Petitions.

§ 120‑10.7.  Petitions.

(a)        Filing. – A writtenpetition shall be filed by the contestant with the clerk within 40 daysfollowing the date of service of the notice of intent. The petition shall setforth the facts and arguments supporting the case of the contestant. Acontestee may file a written reply to the petition within five days followingits service on the contestee.

(b)        Affidavits. – Noaffidavit may be made a part of, or filed in support of, a petition or replythereto unless the affidavit has previously been filed with the clerk, pursuantto the written stipulation of the parties or their counsel, on or before thedate established by G.S. 120‑10.6 for the completion of the taking ofdepositions by the proponent of the affidavit.
