§120‑149.2. Definitions.
As used in this Article:
(1) "Assessmentreport" means a report that initially describes the need for and thefiscal impact of a new licensing board.
(2) "Committee"means the Legislative Committee on New Licensing Boards.
(3) "Licensing"means a regulatory system that requires persons to meet certain qualificationsbefore they are eligible to engage in a particular occupation or profession,but does not include a regulatory system that imposes certain qualifications asa condition for using or advertising specified titles or descriptions inconnection with a particular occupation or profession, unless the restrictionson the use and advertisement of said titles is so broad as to effectivelyprohibit the practitioner from engaging in the profession or occupation withoutmeeting the qualifications.
(4) "New licensingboard" includes each of the following:
a. A proposed new boardwith licensing authority over an occupation or profession; and
b. An existing boardwith proposed licensing authority over an occupation or profession notpreviously licensed by the board; provided, however, that the Committee, inreviewing a proposal to license a profession or occupation under an existingboard, shall not assess the need for the continued licensing of professions andoccupations already within the board's jurisdiction.
(5) "Supplementaryreport" means a report that assesses the changes proposed by an amendmentor committee substitute which would substantially alter a legislative proposalto create a new licensing board and for which an assessment report has alreadybeen prepared. (1987, c. 180; 1997‑456, s. 27.)
