§ 120-33. Duties of enrolling clerk.

§120‑33.  Duties of enrolling clerk.

(a)        All bills passed bythe General Assembly shall be enrolled for ratification under the supervisionof the enrolling clerk.

(b)        Prior to enrollingany bill, the enrolling clerk shall substitute the corresponding Arabicnumeral(s) for any date or section number of the General Statutes or of any actof the General Assembly which is written in words. The enrolled bill shall havethe word "RATIFIED" following the bill number.

(c)        All bills shall betypewritten and carefully proofread before enrollment.

(d)        Upon ratificationof an act or joint resolution, the enrolling clerk shall present one trueratified copy:

(1)        To the Governor ofany act except acts not required to be presented to the Governor under ArticleII, Section 22 of the Constitution of North Carolina; and

(2)        To the Secretary ofState of:

a.         Acts not required tobe presented to the Governor under Article II, Section 22 of the Constitutionof North Carolina; and

b.         Joint resolutions.

In the case of any bill presentedto the Governor, the enrolling clerk shall write upon the bill the time anddate presented to the Governor.

(d1)      The enrolling clerkshall present to the Secretary of State one true ratified copy of:

(1)        Any bill which hasbecome law with the approval of the Governor as provided by G.S. 120‑29.1(a);

(2)        Any bill which hasbecome law without the approval of the Governor as provided by G.S. 120‑29.1(b);and

(3)        Any bill which hasbecome law notwithstanding the objections of the Governor, as provided by G.S.120‑29.1(c).

(d2)      No bill required tobe presented to the Governor under Article II, Section 22 of the Constitutionof North Carolina shall be so presented until the next business day after thebill was ratified, unless expressly ordered by that house where such bill wasordered enrolled. For the purpose of this section, a business day is a weekdayother than one on which there is both a State employee holiday and neitherhouse is in session. No bill required to be presented to the Governor under ArticleII, Section 22 of the North Carolina Constitution shall be recalled from theEnrolling Clerk or Governor after it has been ratified but before it has beenacted upon by the Governor except by joint resolution.

(e)        Repealed by SessionLaws 1995, c. 20, s. 1.

(f)         The enrollingclerk upon completion of duties after each session shall deposit the originalbills and resolutions enrolled for ratification with the Secretary of State. (1969,c. 1184, s. 3; 1995, c. 20, s. 1; 1997‑1, s. 1.)
