§ 121-5.1. State Historical Records Advisory Board.

§ 121‑5.1.  StateHistorical Records Advisory Board.

(a)        The StateHistorical Records Advisory Board, which was constituted in 1975 in accordancewith 44 U.S.C. § 2501; 36 C.F.R. § 1206 is continued under State law and shallbe located administratively in the Department of Cultural Resources. The Boardshall consist of 10 members. Eight members shall be appointed by the Governorfor three‑year staggered terms, and each member shall have experience inthe administration and use of historical records. All current members shallcontinue to serve until the expiration of their term unless a member is removedor the position becomes vacant, in which case the vacancy shall be filled inaccordance with subsection (c) of this section. The Deputy Secretary of the Officeof Archives and History and the State Archivist shall both serve as ex officiomembers of the Board.

(b)        The Board's primaryduty shall be to serve as the central advisory body for historical recordscoordination within the State and for the National Historical Publications andRecords Commission (NHPRC). In addition, subject to the availability of funds,the Board shall:

(1)        Offer assistance,advice, and consultation to State, county, and municipal governments, historicsites, museums, historical societies, and other institutions holding records ofhistorical value concerning the care, preservation, and management of theirrecords.

(2)        Solicit, review, andassess grant proposals in connection with NHPRC grants or grants from othersources.

(3)        Offer educationalprograms and conferences.

(4)        Conduct statewidestudies and surveys of the State's historical records.

(c)        The Governor mayremove any member for good cause shown. The Governor shall fill any vacancy onthe Board. Appointees to fill vacancies shall serve the remainder of theunexpired term and until their successors have been appointed and qualified.

(d)        Members of theBoard shall receive per diem and reimbursement for travel and subsistence asprovided in G.S. 138‑5 and G.S. 138‑6, as appropriate.

(e)        The Governor shallappoint either the Deputy Secretary of the Office of Archives and History orthe State Archivist as the State coordinator as required by NHPRC regulations.The State coordinator shall serve a four‑year term and may bereappointed. The State coordinator may designate a deputy State coordinatorfrom the Board's membership.

(f)         The Board shallhold at least two meetings each year to conduct business. The Board shallestablish the procedures for calling, holding, and conducting regular andspecial meetings. A majority of the members of the Board constitutes a quorumfor the transaction of business. (2007‑150, s. 1.)
