Licensure of Facilitiesfor the Mentally Ill, the Developmentally Disabled, and Substance Abusers.

§ 122C‑21.  Purpose.

The purpose of this Article isto provide for licensure of facilities for the mentally ill, developmentallydisabled, and substance abusers by the development, establishment, andenforcement of basic rules governing:

(1)        The provision ofservices to individuals who receive services from licensable facilities asdefined by this Chapter, and

(2)        The construction,maintenance, and operation of these licensable facilities that in the light ofexisting knowledge will ensure safe and adequate treatment of theseindividuals. The Department shall ensure that licensable facilities areinspected every two years to determine compliance with physical plant and life‑safetyrequirements.
