§126‑3. Office of State Personnel established and responsibilitiesoutlined; administration and supervision; appointment, compensation and tenureof Director.
(a) There is herebyestablished the Office of State Personnel (hereinafter referred to as "theOffice") which shall be placed for organizational purposes within theDepartment of Administration. Notwithstanding the provisions of North CarolinaState government reorganization as of January 1, 1975, and specificallynotwithstanding the provisions of Chapter 864 of the 1971 North CarolinaSession Laws [Chapter 143A], the Office of State Personnel shall exercise allof its statutory powers in this Chapter independent of control by the Secretaryof Administration and shall be under the administration and supervision of aState Personnel Director (hereinafter referred to as "the Director")appointed by the Governor and subject to the supervision of the Commission forpurposes of this Chapter. The salary of the Director shall be fixed by the GeneralAssembly in the Current Operations Appropriations Act. The Director shall serveat the pleasure of the Governor.
(b) The Office shall beresponsible for the following activities, and such other activities asspecified in this Chapter:
(1) Providing policy andrule development for the Commission and implementing and administering allpolicies, rules, and procedures established by the Commission;
(2) Providing trainingin personnel management to agencies, departments, and institutions includingtrain‑the‑trainer programs for those agencies, departments, andinstitutions who request such training and where sufficient staff and expertiseexist to provide the training within their respective agencies, departments,and institutions;
(3) Providing technicalassistance in the management of personnel programs and activities to agencies,departments, and institutions;
(4) Negotiatingdecentralization agreements with all agencies, departments, and institutionswhere it is cost‑effective to include delegation of authority for certainclassification and corresponding salary administration actions and otherpersonnel programs to be specified in the agreements;
(5) Administering suchcentralized programs and providing services as approved by the Commission whichhave not been transferred to agencies, departments, and institutions or wherethis authority has been rescinded for noncompliance;
(6) Providing approvalauthority of personnel actions involving classification and compensation wheresuch approval authority has not been transferred by the Commission to agencies,departments, and institutions or where such authority has been rescinded fornoncompliance;
(7) Maintaining acomputer database of all relevant and necessary information on employees andpositions within agencies, departments, and institutions in the State'spersonnel system;
(8) Developing criteriaand standards to measure the level of compliance or noncompliance withestablished Commission policies, rules, procedures, criteria, and standards inagencies, departments, and institutions to which authority has been delegatedfor classification, salary administration and other decentralized programs, anddetermining through routine monitoring and periodic review process, thatagencies, departments, and institutions are in compliance or noncompliance withestablished Commission policies, rules, procedures, criteria, and standards;and
