§ 127A-32. Officers appointed and commissioned; oath of office.

§ 127A‑32.  Officersappointed and commissioned; oath of office.

All officers of the NationalGuard shall be appointed and commissioned by the Governor as follows, viz.:

(1)        Except as otherwisespecifically provided by the laws of the United States, the qualifications forappointment as an officer in the National Guard shall be the same as thoseprescribed for the regular establishment, subject to such general exceptions asmay be authorized by the Secretary of Defense.

(2)        Candidates for suchappointment shall make written application therefor on such forms as may beprescribed by the secretary of the appropriate service, to the AdjutantGeneral, State of North Carolina, through command channels for comment byendorsements thereon.

(3)        No person shallhereafter be appointed an officer of the National Guard unless he hasestablished to the satisfaction of a board of officers his physical, moral, andprofessional qualifications to perform the duties of the grade and position forwhich examined, subject to such general exceptions as may be authorized by theSecretary of Defense. The board shall consist of three or more commissionedofficers of the appropriate service, appointed under such regulations as may bepromulgated by the secretary of the appropriate service.

(4)        Candidates appointedas officers of the National Guard shall take and subscribe to the followingoath of office:

"I,(First Name – Middle Name – Last Name), do solemnly swear that I will supportand defend the Constitution of the United States and the Constitution of theState of North Carolina against all enemies, foreign and domestic; that I willbear true faith and allegiance to the same; that I will obey orders of thePresident of the United States and of the Governor of the State of North Carolina;that I make this obligation freely, without any mental reservation or purposeof evasion, and that I will well and faithfully discharge the duties of theoffice of (Grade) (Branch) in the National Guard of the State of North Carolinaupon which I am about to enter, so help me God."  (1917, c. 200, s. 15; C.S.,s. 6811; 1921, c. 120, s. 3; 1959, c. 218, s. 5; 1973, c. 620, s. 9; 1975, c.604, s. 2; 2009‑281, s. 1.)
