§ 130A-255. Provisional permit; performance bond; liability insurance.

§130A‑255.  Provisional permit; performance bond; liability insurance.

(a)        Within 15 daysafter the receipt of the application, the Secretary shall review theapplication and inspect the proposed site for the mass gathering. If it islikely that the requirements of this Part and the rules of the Commission canbe met by the applicant, a provisional permit shall be issued.

(b)        The Secretary shallrequire the permittee within five days after issuance of the provisional permitto file with the Secretary a performance bond or other surety to be executed tothe State in the amount of five thousand dollars ($5,000) for up to 10,000persons and an additional one thousand dollars ($1,000) for each additional5,000 persons or fraction reasonably estimated to attend the mass gathering.The bond shall be conditioned on full compliance with this Part and the rulesof the Commission and shall be forfeitable upon noncompliance and a showing bythe Secretary of injury, damage or other loss to the State or local governmentalagencies caused by the noncompliance.

(c)        The permittee shallin addition file satisfactory evidence of public liability and property damageinsurance in an amount determined by the Secretary to be reasonable, not toexceed one million dollars ($1,000,000) in amount, in relation to the risks andhazards involved in the proposed mass gathering.
