§130A‑309.23. Certification of used oil transporters.
(a) Any person whotransports over public highways after 1 January 1992, more than 500 gallons ofused oil in any week must be a certified transporter or must be employed by aperson who is a certified transporter.
(b) The Department ofTransportation shall develop a certification program for transporters of usedoil, and shall issue, deny, or revoke certifications authorizing the holder totransport used oil. Certification requirements shall help assure that a usedoil transporter is familiar with appropriate rules and used oil managementprocedures.
(c) The Department ofTransportation shall adopt rules governing certification, which shall includerequirements for the following:
(1) Registration and annualreporting pursuant to G.S. 130A‑309.17.
(2) Evidence offamiliarity with applicable State laws and rules governing used oiltransportation.
(3) Proof of liabilityinsurance or other means of financial responsibility for any liability whichmay be incurred in the transport of used oil.
(4) Marking, by thecertified transporter of used oil, of all vehicles which transport used oil orall containers of used oil when it is not feasible to mark the vehicle. Themark must clearly identify the certified used oil transporter and clearlyindicate that the vehicle is used to transport used oil. The marking must bevisible to others travelling on the highway.
