§ 130A‑309.84.  Civilpenalties for improper disposal.

The Department may assess acivil penalty of not more than one hundred dollars ($100.00) against a personwho, knowing it is unlawful, places or otherwise disposes of a discarded whitegood in a landfill, an incinerator, or a waste‑to‑energy facility.The Department may assess this penalty for the day the unlawful disposal occursand each following day until the white good is disposed of properly.

The Department may assess apenalty of up to one hundred dollars ($100.00) against a person who, knowing itis required, fails to remove chlorofluorocarbon refrigerants from a discardedwhite good. The Department may assess this penalty for the day the failureoccurs and each following day until the chlorofluorocarbon refrigerants areremoved.

The clear proceeds of civilpenalties assessed pursuant to this section shall be remitted to the CivilPenalty and Forfeiture Fund in accordance with G.S. 115C‑457.2. (1993,c. 471, s. 4; 1998‑215, s. 59.)
