§ 130A‑4. Administration.

(a)        Except as providedin subsection (c) of this section, the Secretary shall administer and enforcethe provisions of this Chapter and the rules of the Commission. A local healthdirector shall administer the programs of the local health department andenforce the rules of the local board of health.

(b)        When requested bythe Secretary, a local health department shall enforce the rules of theCommission under the supervision of the Department. The local health departmentshall utilize local staff authorized by the Department to enforce the specificrules.

(c)        The Secretary ofEnvironment and Natural Resources shall administer and enforce the provisionsof Part 4 of Article 5 and Articles 8, 9, 10, 11, and 12 of this Chapter andthe rules of the Commission.

(d)        When requested bythe Secretary of Environment and Natural Resources, a local health departmentshall enforce the rules of the Commission and the rules adopted by theEnvironmental Management Commission pursuant to G.S. 87‑87 under thesupervision of the Department of Environment and Natural Resources. The localhealth department shall utilize local staff authorized by the Department ofEnvironment and Natural Resources to enforce the specific rules.
