§ 130A-477. Abatement of public health threat.

§ 130A‑477.  Abatementof public health threat.

If it is determined that apublic health threat may exist because of the contamination of property causedby a terrorist incident using nuclear, biological, or chemical agents, theState Health Director may order any action to abate that public health threat.To the extent that any owner, lessee, operator, or other person in control ofthe property is innocent of culpability in the creation of the public healththreat, that person shall not be responsible for the costs of abating thepublic health threat.
