§ 131E‑312. Regulations.
This Article shall be self‑implementing. No later than six monthsafter the date of enactment of this Article, the Division may adopt rulesconsistent with this Article to authorize and regulate provider sponsoredorganizations to contract directly with the federal Medicare program to providehealth care services to the beneficiaries of such programs. The Division shallissue permanent rules and, may issue temporary rules, to the extent these rulesmay be necessary. The Division shall limit its regulation of provider sponsoredorganizations to the licensing and regulating of these organizations as risk‑bearingentities contracting directly with the Medicare program and to the consumerprotection and quality standards as provided in G.S. 131E‑294 and shallnot regulate any matters described in 42 U.S.C. § 1395W‑26(b)(3), or anysuccessor thereof.
