§ 133‑8. Moving andrelated expenses.
(a) Whenever theacquisition of real property for a program or project undertaken by an agencywill result in the displacement of any person, such agency shall make a paymentto any displaced person, upon application as approved by the head of the agencyfor:
(1) Actual reasonableexpenses in moving himself, his family, business, farm operation, or otherpersonal property;
(2) Actual direct lossesof tangible personal property as a result of moving or discontinuing a businessor farm operation, but not to exceed an amount equal to the reasonable expensesthat would have been required to relocate such property, as determined by therelocation officer; and
(3) Actual reasonableexpenses in searching for a replacement business or farm in accordance withcriteria established by the lead agency, but not to exceed two thousand fivehundred dollars ($2,500); and
(4) Actual reasonableexpenses necessary to reestablish a displaced farm, nonprofit organization, orsmall business at its new site, in accordance with criteria to be establishedby the lead agency, but not to exceed ten thousand dollars ($10,000).
(b) Any displacedperson eligible for payments under subsection (a) of this section who isdisplaced from a dwelling and who elects to accept the payments authorized bythis subsection in lieu of the payments authorized by subsection (a) of thissection may receive an expense and dislocation allowance, which shall bedetermined according to a schedule established by the lead agency.
(c) Any displacedperson eligible for payments under subsection (a) of this section who isdisplaced from the person's place of business or farm operation and who iseligible under criteria established by the lead agency may elect to accept thepayment authorized by this subsection in lieu of the payment authorized bysubsection (a) of this section. Such payment shall consist of a fixed paymentin an amount to be determined according to criteria established by the leadagency, except that such payment shall not be less than one thousand dollars($1,000) nor more than twenty thousand dollars ($20,000). A person whose solebusiness at the displacement dwelling is the rental of such property to othersshall not qualify for a payment under this subsection.
