§ 135-14. Pensions of certain former teachers and State employees.

§135‑14.  Pensions of certain former teachers and State employees.

On and after July 1, 1983,special pensions and allowances of certain former teachers and State employeesshall be paid out of the Pension Accumulation Fund of the Retirement System, asfollows:

(1)        Any person who was ateacher or employee, as defined in G.S. 135‑1(10) and (25), for 20 ormore years, whose separation from service was prior to April 1, 1956, was notdue to any dishonorable cause, and who had attained age 65 prior to July 1, 1960,shall upon application be paid an allowance of one hundred seventy‑threedollars and twenty‑five cents ($173.25) per month.

(2)        Any beneficiary whodid not qualify for Social Security benefits and had 20 or more years ofcreditable service and qualified for a minimum eighty‑five dollars($85.00) per month under the provisions of Chapter 1140 of the 1965 SessionLaws, shall be paid the allowance in effect on June 30, 1983.

(3)        Any beneficiary whodid not qualify for Social Security benefits and who had 15 years but less than20 years of creditable service and qualified for a benefit of four dollars($4.00) per month for each year of creditable service under the provisions ofChapter 1199 of the 1965 Session Laws shall be paid the allowance in effect on June30, 1983.

(4)        All the allowancesin subsections (1) through (3) of this section may be adjusted by any cost‑of‑livingincreases in retirement allowances provided by the General Assembly or by theBoard of Trustees.
