§135‑30. State employees members of Law‑Enforcement Officers'Benefit and Retirement Fund.
The federal‑stateagreement provided in G.S. 135‑21 shall be revised and extended toprovide that, effective on, or retroactively as of, such date as may be fixed bythe Board of Commissioners of the Law‑Enforcement Officers' Benefit andRetirement Fund, all or some of the members of said fund who are employees ofthe State of North Carolina or any of its agencies, shall be covered by theSocial Security Act, dependent upon a referendum or referendums held pursuantto federal laws and regulations, at the request of said board, with theapproval of the Governor: Provided, that such action shall be subject to theconditions and terms set forth in such agreement and subject to all applicableprovisions of Article 2 of Chapter 135 of the General Statutes not inconsistentherewith: Provided, however, that the effecting of social security coverageshall not cause to be reduced or lowered the amount of the contributions to bemade to the Law‑Enforcement Officers' Benefit and Retirement Fund by anyState employee who is a member thereof nor the amount to be contributed by theState to said fund with respect to each State employee member; provided,further, from and after the date the above‑described employees becomesubject to the Social Security Act, there shall be deducted from each suchemployee's salary for each and every payroll period such sum as may benecessary to pay the amount of contributions of taxes required on his accountwith respect to social security coverage, and the State, or the appropriateState agency, as an employer, shall pay the amount of contributions or taxeswith respect to such person, as may be necessary on his account to effect theabove‑described social security coverage.
