§ 136‑102.2. Authorization required for test drilling or boring upon right‑of‑way;filing record of results with Department of Transportation.

No person, firm or corporationshall make any test drilling or boring upon the right‑of‑way of anytransportation system, under the jurisdiction of the Department ofTransportation, until written authorization has been obtained from the owner orthe person in charge of the land on which the highway easement is located. Acomplete record showing the results of the test drilling or boring shall befiled forthwith with the chairman [Secretary] of the Department ofTransportation and shall be a public record. This section shall not apply tothe Department of Transportation making test drilling or boring for highway purposesonly.  (1967, c.923, s. 1; 1973, c. 507, s. 5; 1977, c. 464, s. 7.1; 2009‑266, s. 25.)
