§ 136‑34.1.  Departmentof Transportation authorized to furnish road maintenance materials tomunicipalities.

The Department ofTransportation is authorized, in its discretion, to furnish municipalities roadmaintenance materials to aid municipalities in the maintenance of streets uponagreement for reimbursement, as may be required by the Department and agreed toby the municipality. The agreement shall provide for reimbursement in an amountat least equal to the cost of the materials, together with the actualreasonable cost of any handling and storage of the materials and ofadministering the reimbursement agreement, all as solely determined by theDepartment. In no event shall the Department of Transportation be required tofurnish road maintenance materials when, in the sole determination of theDepartment of Transportation, to do so would interfere with the maintenance ofthe streets and highways under its control. Notwithstanding any other provisionof law, the provision of and reimbursement for materials under this sectionshall not be deemed a sale for any purpose.  (2009‑332, s. 3.)
