§ 143‑215.10E. Violations requiring immediate notification.

(a)        Any employee of a State agency or unit of local governmentlawfully on the premises and engaged in activities relating to the animaloperation who observes any of the following violations shall immediately notifythe owner or operator of the animal operation and the Division:

(1)        Any direct discharge of animal waste into the waters of theState.

(2)        Any deterioration or leak in a lagoon system that poses animmediate threat to the environment.

(3)        Failure to maintain adequate storage capacity in a lagoonthat poses an immediate threat to public health or the environment.

(4)        Overspraying animal waste either in excess of the limits setout in the animal waste management plan or where runoff enters waters of theState.

(5)        Any discharge that bypasses a lagoon system.

(b)        Any employee of a federal agency lawfully on the premisesand engaged in activities relating to the animal operation who observes any ofthe above violations is encouraged to immediately notify the Division. (1995 (Reg. Sess., 1996), c. 626, s. 1.)
