§ 143-215.94FF. Authorization of the Attorney General; citizens' suits.

§ 143‑215.94FF. Authorization of the Attorney General; citizens' suits.

(a)        For any violation of this Part, the Attorney General may, onbehalf of the State and on behalf of affected citizens of the State as a class,bring a civil action in the Superior Court of Wake County against the allegedresponsible person.  The action may seek:

(1)        Injunctive relief; or

(2)        Damages caused by the violation; or

(3)        Both damages and injunctive relief; or

(4)        Such other and further relief in the premises as the Courtshall deem proper.

(b)        Any injured party under this Part may bring a civil actionfor damages against the alleged responsible person.  Civil actions under thissubsection shall be brought in the superior court of the county in which thealleged injury occurred or in which the alleged damaged property is located, orin the county in which the injured party resided.

(c)        Nothing in this section shall restrict any right which anyperson (or class of persons) may have under any statute or common law to seekinjunctive or other relief. (1989, c. 656, s. 5, c. 770, s. 75.5.)
