§ 143B-133.1. Powers of Commission.

§ 143B‑133.1.  Powers of Commission.

(a)        The Commission shall cause to be erected on the CapitolGrounds a monument to the veterans of World War I, World War II, and the KoreanWar.

(b)        The Commission may, in its discretion, hire any person orpersons to design, construct, and erect the monument, and shall choose itslocation on the Capitol Grounds, in accordance with the review procedures ofthe North Carolina Historical Commission as set forth in Chapter 100 of theGeneral Statutes, and without regard to Article 8 of Chapter 143 of the GeneralStatutes, G.S. 143B‑373, or G.S. 147‑12(12).

(c)        Further, when a designer is selected and awarded a contractby the Commission to construct and erect the memorial, the Commission shall soadvise, in writing, the Office of State Budget and Management of the totalamount of the contract, a schedule of payments to be executed, if required,including any particular conditions upon which final acceptance of the Memorialand payment to the designer shall be made. Upon receipt of this document, theOffice of State Budget and Management shall cause disbursements to be made fromthe Reserve established by Section 3 of Chapter 971, Session Laws of 1983, inaccordance with the Commission's contractual obligations.
