§ 143B‑14. Administrative services to commissions.

(a)        The head of the principal State department to which acommission has been assigned is responsible for the provision of alladministrative services to the commission.

(b)        Except as otherwise provided by law, the powers, duties, andfunctions of a commission are not subject to the approval, review, or controlof the head of the department or of the Governor.

(c)        The Governor may assign to an appropriate commission createdby the Executive Organization Act of 1973 duties of a quasi‑legislativeand quasi‑judicial nature existing in the executive branch of Stategovernment which have not been assigned by this Chapter to any othercommission. All such assignment of duties by the Governor to a commission shallbe made in accordance with Article III, Sec. 5(10) of the Constitution of NorthCarolina.

(d)        All management functions of a commission shall be performedby the head of the principal State department. Management functions shallinclude planning, organizing, staffing, directing, coordinating, reporting, andbudgeting.
