§ 143B‑289.56. Marine Fisheries Commission – meetings; quorum.

(a)        The Commission shall meet at least once each calendarquarter and may hold additional meetings at any time and place within the Stateat the call of the Chair or upon the written request of at least four members.At least three of the four quarterly meetings of the Commission shall be heldin one of the coastal regions designated in G.S. 143B‑289.54.

(b)        (1)        Six members of the Commissionshall constitute a quorum for the transaction of business.

(2)        A quorum of the Commission may transact business only if onemember, other than the Chair, appointed pursuant to subdivision (1), (2), or(3) of G.S. 143B‑289.54(a) and one member, other than the Chair,appointed pursuant to subdivision (4), (5), or (6) of G.S. 143B‑289.54(a)are present.

(c)        If the Commission is unable to transact business because therequirements of subdivision (2) of subsection (b) of this section are not met,the Chair shall call another meeting of the Commission within 30 days and shallplace on the agenda for that meeting every matter with respect to which theCommission was unable to transact business. Five members of the Commissionshall constitute a quorum for the transaction of business at a meeting calledunder this subsection. The requirements of subdivision (2) of subsection (b) ofthis section shall not apply to a meeting called under this subsection. (1997‑400, s. 2.1; 1998‑225, s. 1.8.)
