§ 153A‑349.50.  Purposeand compliance with federal law.

(a)        Purpose. – Thepurpose of this section is to ensure the safe and efficient integration offacilities necessary for the provision of advanced wireless telecommunicationsservices throughout the community and to ensure the ready availability ofreliable wireless service to the public, government agencies, and firstresponders, with the intention of furthering the public safety and generalwelfare. The following standards shall apply to a county's actions, as aregulatory body, in the regulation of the placement, construction, ormodification of a wireless communications facility.

(b)        Compliance with theFederal Communications Act. – The placement, construction, or modification ofwireless communications facilities shall be in conformity with the FederalCommunications Act, 47 U.S.C. § 332 as amended, and in accordance with therules promulgated by the Federal Communications Commission.
