§ 156-20. Right of dominant owner to repair.

§ 156‑20.  Right ofdominant owner to repair.

In the absence of any agreement for maintaining the efficiency of suchditch or canal, or should the servient owner neglect or refuse to clean out oraid in cleaning out the same through his lands, it shall be lawful for thedominant or higher owner, after giving three days' notice to the servientowner, to enter along such canal and not more than 12 feet therefrom and cleanout or remove obstructions or accumulated debris therefrom at his own personalexpense or without cost to the servient owner.
