§ 156‑59. Board ofviewers appointed by clerk.
The clerk shall, on the filing of petition and bond, appoint adisinterested and competent civil and drainage engineer and two residentfreeholders of the county or counties in which the lands are located as a boardof viewers to examine the lands described in the petition and make apreliminary report thereon. The drainage engineer shall be appointed upon therecommendation of the Department of Environment and Natural Resources; and nomember of the board of viewers so appointed shall own any land within theboundaries of the proposed district. In the selection of the two members of theboard of viewers, other than the engineer, the clerk before making theappointment shall make careful inquiry into the character and qualifications ofthe proposed members, to the end that the members so appointed shall possessthe necessary character, capacity, fitness, and impartiality for the dischargeof their important duties.
