§ 15A‑534.5. Detentionto protect public health.
If a judicial officialconducting an initial appearance finds by clear and convincing evidence that aperson arrested for violation of an order limiting freedom of movement oraccess issued pursuant to G.S. 130A‑475 or G.S. 130A‑145 poses athreat to the health and safety of others, the judicial official shall denypretrial release and shall order the person to be confined in an area orfacility designated by the judicial official. Such pretrial confinement shallterminate when a judicial official determines that the confined person does notpose a threat to the health and safety of others. These determinations shall bemade only after the State Health Director or local health director has maderecommendations to the court. (2002‑179, s. 15.)
