§ 15A‑831.1. Polygraphexaminations of victims of sexual assaults.
(a) A criminal orjuvenile justice agency shall not require a person claiming to be a victim ofsexual assault or claiming to be a witness regarding the sexual assault ofanother person to submit to a polygraph or similar examination as aprecondition to the agency conducting an investigation into the matter.
(b) An agency wishingto perform a polygraph examination of a person claiming to be a victim orwitness of sexual assault shall inform the person of the following:
(1) That taking thepolygraph examination is voluntary.
(2) That the results ofthe examination are not admissible in court.
(3) That the person'sdecision to submit to or refuse a polygraph examination will not be the sole basisfor a decision by the agency not to investigate the matter.
(c) An agency whichdeclines to investigate an alleged case of sexual assault following a decisionby a person claiming to be a victim not to submit to a polygraph examinationshall provide to that person, in writing, the reasons why the agency did notpursue the investigation at the request of the person.
