§ 160A‑400.24. Public hearing.
Before entering into a development agreement, a local government shallconduct a public hearing on the proposed agreement following the procedures setforth in G.S. 160A‑364 regarding zoning ordinance adoption oramendment. The notice for the public hearing must specify the location of theproperty subject to the development agreement, the development uses proposed onthe property, and must specify a place where a copy of the proposed developmentagreement can be obtained. In the event that the development agreement providesthat the local government shall provide certain public facilities, thedevelopment agreement shall provide that the delivery date of such publicfacilities will be tied to successful performance by the developer inimplementing the proposed development (such as meeting defined completionpercentages or other performance standards).
