§ 160B-9. Required provision or maintenance of services, facilities and functions.

§ 160B‑9.  Requiredprovision or maintenance of services, facilities and functions.

(a)        New District. – When a consolidated city‑countydefines a new urban service district, it shall provide or maintain theservices, facilities and functions for which the residents of the district arebeing taxed within a reasonable time, not to exceed one year, after theeffective date of the definition of the district.

(b)        Extended District. – When a consolidated city‑countyannexes territory to an urban service district, it shall provide or maintainthe services, facilities and functions provided or maintained throughout thedistrict to the residents of the area annexed to the district within areasonable time not to exceed one year, after the effective date of the annexation.

(c)        Consolidated District. – When a consolidated city‑countyconsolidates two or more urban service districts, one of which has provided ormaintained a lower level of urban services, it shall increase the services,facilities and functions within that district to a level comparable to thoseprovided or maintained elsewhere in the consolidated district within areasonable time, not to exceed one year, after the effective date of theconsolidation.
