§ 163-278.103. Determination of candidate-specific communication.

§ 163‑278.103. Determination of candidate‑specific communication.

(a)        Any individual,committee, association, or any other organization or group of individuals thatproduces a communication to be aired to the relevant electorate in the timeperiods under G.S. 163‑278.100(1)b. may, but is not required to, ask theState Board for a determination as to whether or not that communication is acandidate‑specific communication prior to the airing of thatcommunication.

(b)        The State Boardshall establish a process for determination as to whether a communication is acandidate‑specific communication prior to the airing of thatcommunication when it is requested under subsection (a) of this section. Theresponsibility for the determination may be delegated to the ExecutiveDirector. If the responsibility is delegated to the Executive Director, theprocess established by the State Board shall include an opportunity forimmediate appeal to the State Board of the determination by the ExecutiveDirector.  (2009‑534,s. 9(c).)
