§ 20‑308.22. Applicability of this Article.
(a) Any captive financesource who engages directly or indirectly in purposeful contacts within thisState in connection with the offering or advertising the availability offinancing for the sale or lease of motor vehicles within this State, or who hasbusiness dealings within this State, shall be subject to the provisions of thisArticle and shall be subject to the jurisdiction of the courts of this State.
(b) The applicabilityof this Article shall not be affected by a choice of law clause in anyagreement, waiver, novation, or any other written instrument.
(c) Any provision ofany agreement, waiver, novation, or any other written instrument which is inviolation of any section of this Article shall be deemed null and void andwithout force and effect to the extent it violates this section.
(d) It shall beunlawful for a captive finance source to use any subsidiary corporation,affiliated corporation, or any other controlled corporation, partnership,association, or person to accomplish what would otherwise be illegal conductunder this Article on the part of the captive finance source.
