§ 20-37.5. Definitions.

§ 20‑37.5.  Definitions.

Unless the context requiresotherwise, the following definitions apply throughout this Article to thedefined words and phrases and their cognates:

(1)        "Distinguishinglicense plate" means a license plate that displays the InternationalSymbol of Access using the same color, size of plate, and size of letters ornumbers as a regular plate.

(2)        "Handicapped"shall mean a person with a mobility impairment who, as determined by a licensedphysician:

a.         Cannot walk 200 feetwithout stopping to rest;

b.         Cannot walk withoutthe use of, or assistance from, a brace, cane, crutch, another person,prosthetic device, wheelchair, or other assistive device;

c.         Is restricted bylung disease to such an extent that the person's forced (respiratory) expiratoryvolume of one second, when measured by spirometry, is less than one liter, orthe arterial oxygen tension is less than 60 mm/hg on room air at rest;

d.         Uses portableoxygen;

e.         Has a cardiaccondition to the extent that the person's functional limitations are classifiedin severity as Class III or Class IV according to standards set by the AmericanHeart Association;

f.          Is severely limitedin their ability to walk due to an arthritic, neurological, or orthopediccondition; or

g.         Is totally blind orwhose vision with glasses is so defective as to prevent the performance ofordinary activity for which eyesight is essential, as certified by a licensedophthalmologist, optometrist, or the Division of Services for the Blind.

(3)        "InternationalSymbol of Access" means the symbol adopted by Rehabilitation Internationalin 1969 at its Eleventh World Congress on Rehabilitation of the Disabled.

(4)        "Removablewindshield placard" means a two‑sided, hooked placard which includeson each side:

a.         The InternationalSymbol of Access, which is at least three inches in height, centered on theplacard, and is white on a blue shield;

b.         An identificationnumber;

c.         An expiration datethat is visible from at least 20 feet and the month and year of expiration; and

d.         The seal or otheridentification of the issuing authority.  (1967, c. 296, s. 5; 1977, c. 340, s. 1; 1991, c.411, s. 1; 2009‑493, s. 1.)
