§ 25-2-611. Retraction of anticipatory repudiation. - North Carolina Statutes

§25‑2‑611.  Retraction of anticipatory repudiation.

(1)        Until therepudiating party's next performance is due he can retract his repudiationunless the aggrieved party has since the repudiation cancelled or materiallychanged his position or otherwise indicated that he considers the repudiationfinal.

(2)        Retraction may beby any method which clearly indicates to the  aggrieved party that therepudiating party intends to perform, but must include any assurancejustifiably demanded under the provisions of this article (G.S. 25‑2‑609).

(3)        Retractionreinstates the repudiating party's rights under the  contract with due excuseand allowance to the aggrieved party for any delay occasioned by therepudiation. (1965, c. 700, s. 1.)
