§ 25-2A-520. Lessee's incidental and consequential damages.

§25‑2A‑520.  Lessee's incidental and consequential damages.

(1)        Incidental damagesresulting from a lessor's default include expenses reasonably incurred ininspection, receipt, transportation, and care and custody of goods rightfullyrejected or goods the acceptance of which is justifiably revoked, anycommercially reasonable charges, expenses or commissions in connection witheffecting cover, and any other reasonable expense incident to the default.

(2)        Consequentialdamages resulting from a lessor's default include:

(a)        any loss resultingfrom general or particular requirements and needs of which the lessor at thetime of contracting had reason to know and which could not reasonably beprevented by cover or otherwise; and

(b)        injury to person orproperty proximately resulting from any breach of warranty. (1993,c. 463, s. 1.)
