§ 25A-21. Attorneys' fees.

§25A‑21.  Attorneys' fees.

With respect to a consumercredit sale:

(1)        In the event thatthe seller institutes a suit and prevails in the litigation and obtains a moneyjudgment, the presiding judge shall allow a reasonable attorney's fee to theduly licensed attorney representing the seller in such suit, said attorney'sfee to be taxed to the buyer as part of the court costs.

(2)        In the event that aseller instituting suit does not prevail in the litigation, the presiding judgeshall allow a reasonable attorney's fee to the duly licensed attorneyrepresenting the buyer in such suit, said attorney's fee to be taxed to theseller as a part of the court costs.
