Article 1.
Definitions and OtherGeneral Provisions.
§ 28A‑1‑1. Definitions.
As used in this Chapter,unless the context otherwise requires, the term:
(1) "Collector"means any person authorized to take possession, custody, or control of thepersonal property of the decedent for the purpose of executing the dutiesoutlined in G.S. 28A‑11‑3.
(1a) "Devisee"means any person entitled to take real or personal property under theprovisions of a valid, probated will.
(2) "Foreignpersonal representative" means a personal representative appointed inanother jurisdiction, including a personal representative appointed in anothercountry.
(3) "Heir"means any person entitled to take real or personal property upon intestacyunder the provisions of Chapter 29 of the General Statutes.
(4) "Mortgage"includes a deed of trust.
(5) "Personalrepresentative" includes both an executor and an administrator, but doesnot include a collector.
(6) "Service"means delivery of the citation, summons, notice or other civil process to theperson to be served by an officer authorized to serve process and, if suchservice cannot be obtained, then by the mailing of the citation, summons,notice or other civil process by certified mail, return receipt requested, tothe last known address of the person to be served.
