§30‑30.  Judgment and order for commissioners.

If the material allegations ofthe complaint be found true, the judgment shall be that plaintiff is entitledto the relief sought; and the court shall thereupon issue an order to thesheriff or other proper officer of the county, commanding him to summon amagistrate and two persons qualified to act as jurors, who shall determine themoney or other personal property of the estate and assign to the plaintiff asufficiency thereof for plaintiff's support for one year from the decedent'sdeath. Any deficiency shall be made up from any of the personal property of thedeceased, and if the personal property of the estate shall be insufficient forsuch support, the clerk of the superior court shall enter judgment against thepersonal representative for the amount of such deficiency, to be paid when asufficiency of such assets shall come into his hands.
