§ 33A-19. Accounting by and determination of liability of custodian.

§33A‑19.  Accounting by and determination of liability of custodian.

(a)        A minor who hasattained the age of 14 years, the minor's guardian of the person or legalrepresentative, an adult member of the minor's family, a transferor, or atransferor's legal representative may petition the court (i) for an accountingby the custodian or the custodian's legal representative; or (ii) for adetermination of responsibility, as between the custodial property and thecustodian personally, for claims against the custodial property unless theresponsibility has been adjudicated in an action under G.S. 33A‑17 towhich the minor or the minor's legal representative was a party.

(b)        A successorcustodian may petition the court for an accounting by the predecessor custodian.

(c)        The court, in aproceeding under this Chapter or the presiding judge in any other proceeding,may require or permit the custodian or the custodian's legal representative toaccount.

(d)        If a custodian isremoved under G.S. 33A‑18(f), the court shall require an accounting andorder delivery of the custodial property and records to the successor custodianand the execution of all instruments required for transfer of the custodialproperty. (1987, c. 563, s. 2.)
