§ 35A-1205. Transfer to different county.

§35A‑1205.  Transfer to different county.

At any time before or afterappointing a guardian for a minor or incompetent person the clerk may, on amotion filed in the cause or on the court's own motion, for good cause orderthat the matter be transferred to a different county.  The transferring clerkshall enter a written order directing the transfer under such conditions as theclerk specifies.  The clerk in the transferring county shall transfer alloriginal papers, documents, and orders from the guardianship and theincompetency proceeding, if any, to the clerk of the transferee county, alongwith the order directing the transfer.  The clerk in the transferee countyshall docket and file the papers in the estates division as a basis forjurisdiction in all subsequent proceedings.  The clerk in the transferringcounty shall close his file with a copy of the transfer order and any orderadjudicating incompetence or appointing a guardian. (1987, c. 550, s. 1.)
