§ 45‑36.18.  Affidavitof satisfaction: effect.

(a)        Upon recording, anaffidavit substantially complying with the requirements of G.S. 45‑36.16constitutes a satisfaction of the security instrument described in theaffidavit.

(b)        The recording of anaffidavit of satisfaction of a security instrument does not by itselfextinguish any liability of a person for payment or performance of the securedobligation.

(c)        The register ofdeeds may not refuse to accept for recording an affidavit of satisfaction of asecurity instrument unless:

(1)        The affidavit issubmitted by a method or in a medium not authorized for registration by theregister of deeds under applicable law; or

(2)        The affidavit is notsigned by the satisfaction agent and acknowledged as required by law for aconveyance of an interest in real property. The register of deeds shall not berequired to verify or make inquiry concerning (i) the truth of the mattersstated in any affidavit of satisfaction, or (ii) the authority of the personexecuting any affidavit of satisfaction to do so.
