§ 46-17. Report of commissioners; contents; filing.

§ 46‑17.  Report ofcommissioners; contents; filing.

The commissioners, within areasonable time, not exceeding 90 days after the notification of theirappointment, shall make a full and ample report of their proceedings, under thehands of any two of them, specifying therein the manner of executing theirtrust and describing particularly the land or parcels of land divided, and theshare allotted to each tenant in severalty, with the sum or sums charged on themore valuable dividends to be paid to those of inferior value. The report shallbe filed in the office of the superior court clerk: Provided, that the clerk ofthe superior court may, in the clerk's discretion, for good cause shown, extendthe time for the filing of the report of said commissioners for an additionalperiod not exceeding 60 days. This proviso shall be applicable to proceedingsnow pending for the partition of real property.  (1868‑9, c. 122, s. 5;Code, s. 1896; Rev., s. 2494; C.S., s. 3228; 1949, c. 16; 2009‑362, s.1.)
