§ 53‑208.24. Civilpenalties.
(a) If, after noticeand hearing, the Commissioner finds that a person has intentionally violatedthis Article or a rule adopted under this Article, the Commissioner may orderthe person to pay to the Commissioner a civil penalty in an amount specified bythe Commissioner, not to exceed one thousand dollars ($1,000) for eachviolation or, in the case of a continuing violation, one thousand dollars($1,000) for each day that the violation continues. No proceeding shall be initiatedand no penalty shall be assessed pursuant to this section until after theperson has been notified in writing of the nature of the violation and has beenafforded a reasonable period of time, as set forth in the notice, to correctthe violation and has failed to do so.
(b) The Commissioner,in the exercise of the Commissioner's reasonable judgment, may compromise,settle, and collect civil penalties with any person for violations of anyprovision of this Article, or of any rule, regulation, or order issued orpromulgated to this Article. (2001‑443, s. 2.)
