§ 53‑244.120. Confidentiality of information.
(a) Notwithstanding anyState law to the contrary, the Commissioner shall report enforcement actionsunder this Article and may report other relevant information to the NationwideMortgage Licensing System and Registry.
(b) The Commissioner isauthorized to enter agreements or sharing arrangements with other governmentalagencies, the Conference of State Bank Supervisors, the American Association ofResidential Mortgage Regulators, or other associations representinggovernmental agencies and may share otherwise confidential information pursuantto these written agreements.
(c) The requirements ofG.S. 53‑99(b) regarding the privacy or confidentiality of any informationor material provided under subsections (a) and (b) of this section, and anyprivilege arising under any other federal or State law with respect to suchinformation or material, shall continue to apply to the information or materialafter it has been disclosed to an entity described in subsection (a) or (b) ofthis section. Information or material held by such an entity shall not besubject to disclosure under any State law governing the disclosure to thepublic of information held by an officer or agency of the State. The entitiesdescribed in subsections (a) and (b) of this section may share information andmaterial with all State and federal regulatory officials with mortgage industryoversight authority without the loss of privilege or the loss ofconfidentiality protections provided by State or federal law.
(d) Any provision ofChapter 132 of the General Statutes relating to the disclosure of confidentialsupervisory information or of any information or material described insubsection (a) of this section that is inconsistent with this section shall besuperseded by the requirements of this section.
(e) The confidentialityprovisions contained in subsection (c) of this section shall not apply withrespect to the information or material relating to the employment history ofand publicly adjudicated disciplinary and enforcement actions against mortgagelenders, mortgage brokers, mortgage servicers, or mortgage loan originatorsthat are included in the Nationwide Mortgage Licensing System and Registry foraccess by the public.
