§53‑26.  Petition for new trustee; service upon parties interested.

In all cases of suchinsolvency and liquidation mentioned in G.S. 53‑25, the clerk of thesuperior court of any county in which such indenture, deed of trust or otherinstrument of like character is recorded shall, upon the verified petition ofany person interested in any such trust, either as trustee, beneficiary orotherwise, which interest shall be set out in said petition, enter an orderdirecting service on all interested parties either personally or by thepublication in a newspaper published in the county, or if no newspaper ispublished in the county where such application is made, then in a newspaperhaving a general circulation in such county, of a notice directed to all personsconcerned, commanding and requiring all persons having any interest in saidtrust, to be and appear at his office at a day designated in said order andnotice, not less than 30 days from the date thereof, and show cause why a newtrustee shall not be appointed.
