§ 53-386. Notice and time for filing claims.

§ 53‑386.  Notice andtime for filing claims.

Notice shall be given byadvertisement once a week for four consecutive weeks in a newspaper publishedin the county where the principal office of the State trust company is located,or if no newspaper is published in the county, then in some newspaper having ageneral circulation in the county, calling on all persons who may have claimsagainst the State trust company to present them to the Commissioner at theprincipal office of the State trust company, and within the time to bespecified in the notice which time shall not be less than 90 days from the dateof the first publication. A copy of this notice shall be mailed to all personswhose names appear as creditors upon the books of the State trust company. Affidavitby the Commissioner to the effect that the notice was mailed shall beconclusive evidence thereof. For purposes of this section, clients and accountsof the State trust company shall not be considered creditors of the State trustcompany as to the assets held by the State trust company for the benefit of itsaccounts.
