§ 54B‑268. Applicationrequirements.
(a) Any out‑of‑stateassociation desiring to establish a branch office under this Article shall filewith the Commissioner of Banks a written application meeting the followingrequirements:
(1) The out‑of‑stateassociation shall agree to comply with all the applicable rules andregulations, and informational filing requirements contained in the laws andrules of this State that would apply to a State association engaging in anequivalent form of transaction. Additionally, the Commissioner of Banks shallapply the same standards of approval to the application of the out‑of‑stateassociation as would apply to an application by a State association for anequivalent form of transaction.
(2) The out‑of‑stateassociation shall provide the Commissioner of Banks, in the manner prescribedby the Commissioner of Banks, with such additional information as theCommissioner of Banks deems necessary, to fully evaluate the application.
(3) The out‑of‑stateassociation shall pay an application fee established by the Commissioner ofBanks pursuant to G.S. 54B‑9.
(4) The out‑of‑stateassociation shall not commence operations of the branch office until it hasreceived the written approval of the Commissioner of Banks.
(b) The Commissioner ofBanks shall act on the application within 90 days of receipt of the completedapplication. (1993,c. 191, s. 2; 2001‑193, s. 16.)
