§58‑19‑40. Confidential treatment.
All information, documents,and copies thereof obtained by or disclosed to the Commissioner or any otherperson in the course of an examination or investigation made pursuant to G.S.58‑19‑35, and all information reported pursuant to G.S. 58‑19‑25and G.S. 58‑19‑30, shall be given confidential treatment; shall notbe subject to subpoena; and shall not be made public by the Commissioner, theNAIC, or any other person, except to insurance regulators of other states,without the prior written consent of the insurer or acquiring party to which itpertains unless the Commissioner, after giving the insurer and its affiliatesor the acquiring party that would be affected thereby notice and opportunity tobe heard, determines that the interest of the insurer's policyholders or thepublic will be served by the publication thereof, in which event he may publishall or any part thereof in such manner as he considers appropriate.
