§58‑22‑50.  Administrative and procedural authority regarding riskretention groups and purchasing groups.

The Commissioner is authorizedto make use of any of the powers established under Articles 1 through 64 ofthis Chapter to enforce the laws of this State as long as those powers are notspecifically preempted by the Product Liability Risk Retention Act of 1981, asamended by the Risk Retention Act of 1986.  This includes, but is not limitedto, the Commissioner's administrative authority to investigate, issuesubpoenas, conduct depositions and hearings, issue orders, and seek or imposepenalties.  With regard to any investigation, administrative proceeding, orlitigation, the Commissioner can rely on the procedural law and regulations ofthe State.  The injunctive authority of the Commissioner in regard to riskretention groups is restricted by the requirement that any injunction be issuedby a court of competent jurisdiction.
